1. INTRODUCTION

Welcome to the OM Monitoring System ("System") operated by the National Irrigation Administration Region 3 Bulacan ("NIA"). By accessing or using this System, you agree to be bound by these Terms and Conditions.

2. ACCOUNT REGISTRATION

2.1. To use the System, you must register an account by providing accurate and complete information.

2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

2.3. You agree to notify NIA immediately of any unauthorized use of your account or any other breach of security.

3. SYSTEM USAGE

3.1. The OM Monitoring System is designed for monitoring and managing operations and maintenance activities related to irrigation systems.

3.2. You agree to use the System only for its intended purposes and in compliance with all applicable laws and regulations.

3.3. You shall not use the System to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Engage in any activity that interferes with or disrupts the System
• Attempt to gain unauthorized access to the System or related systems or networks

4. DATA PRIVACY

4.1. NIA collects and processes personal information in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173).

4.2. By using the System, you consent to the collection, processing, and storage of your personal information as described in our Privacy Policy.

4.3. NIA will take reasonable measures to protect your personal information from unauthorized access or disclosure.

5. INTELLECTUAL PROPERTY

5.1. All content and materials available on the System, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of NIA or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2. You may not reproduce, distribute, modify, or create derivative works from any content or materials on the System without the prior written consent of NIA.

6. LIMITATION OF LIABILITY

6.1. NIA provides the System on an "as is" and "as available" basis without warranties of any kind, either express or implied.

6.2. NIA shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the System.

7. TERMINATION

7.1. NIA may terminate or suspend your access to the System at any time, without prior notice or liability, for any reason, including without limitation if you breach these Terms and Conditions.

7.2. Upon termination, your right to use the System will immediately cease.

8. CHANGES TO TERMS AND CONDITIONS

8.1. NIA reserves the right to modify or replace these Terms and Conditions at any time without prior notice.

8.2. Your continued use of the System after any such changes constitutes your acceptance of the new Terms and Conditions.

9. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
